Heard the parties.
The petitioner has been made accused in connection with Kunda P.S. Case No. 56 of 2019, for the offences registered under Sections 302/201/34 of the Indian Penal Code, pending in the court of learned Additional Chief Judicial Magistrate, Chatra.
On 16.09.2019 at about 9:00 P.M., father of the informant had gone to guard his maize field. Thereafter, he went missing. Subsequently, he was found murdered. Suspicion has been raised upon the petitioner and coaccused persons that they might have committed his murder as prior to occurrence, they had threatened the deceased of dire consequences.
It was submitted that apart from suspicion, there is no other material against the petitioner on the record. It was further submitted that similarly situated co-accused persons have been granted bail by this Court as well as Co-ordinate Bench of this Court.
Learned A.P.P. has opposed the prayer for bail.
In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra, in connection with Kunda P.S. Case No. 56 of 2019.
