Heard learned counsel for the applicant and the learned A.P.P. for the State.

This bail application has been filed on behalf of the applicant- Bijay Yadav @ Jatail Yadav with the prayer to release on bail in connection with Sonari P.S. Case No. 130 of 2023 corresponding to S.T. Case No. 60 of 2024, registered under Sections 307, 120B and 34 of the Indian Penal Code and under Section 25 (1-b) a, 26, 35 and 27 of the Arms Act, pending in the Court of the learned Additional Sessions Judge-III, East Singhbhum, Jamshedpur.

The F.I.R. of this case was lodged against the four named accused and unknown persons with these allegations that on 19.09.2023 in between 2:20 to 2:30 two persons came by one black colour motorcycle to his house. They fired twice. Once inside the house and another to the car parked outside the house and while fleeing away, they had criminally intimidated. Having received this information from the members of his

house, he immediately came to his house and on the basis of C.C.T.V. footage came to know the person who had opened the fire was Ajay Gaur, resident of Dumuhani Sonari. A few days before this occurrence Bhaisa @ Pintu Yadav, Jhabbu @ Ritesh Singh, Jatail Yadav along with other associates had criminally intimidated him and by opening fire they have created panic hence this F.I.R. was lodged.

The petitioner is not named in the F.I.R. So far as the allegation of criminal intimidation made by named accused and unknown persons a few days before the occurrence is concerned, for the same admittedly no T.I.P. was conducted to identify the complicity of the petitioner in commission of the said offence. No role of petitioner is shown in opening fire on 19.09.2023. The co-accused Ritesh Kumar Singh @ Jhabbu has been granted bail in B.A.No. 5037 of 2024 vide order dated 31.05.2024 by the Co-ordinate Bench of this Court.

In view of the above, the bail petition of the petitioner is allowed. Let the applicant be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in the aforesaid case.
