/14.03.2024 Heard the learned counsel for the petitioner as well as the learned counsel for the respondent State.

The petitioner is apprehending his arrest in connection with Mango P.S. Case No. 298 of 2023 registered under Sections 270, 272, 273, 290, 420, 467, 468, 471, 34 of the I.P.C. and under sections 47(a), 47(b), 47(c), 47(d), 47(e), 47 (f), 52 of the Excise Act, pending in the Court of learned Judicial Magistrate, East Singhbhum, Jamshedpur.

Learned counsel for the petitioner submits that the petitioner is neither the owner nor the tenant of the house in question that has been disclosed in para 16 of the petition and only on suspicion the name of the petitioner has come. He submits that the allegation is made that Kiran Dhara has stated that house was provided on rent to Jitu @ Jitendra Gupta and the co-accused has been provided privilege of anticipatory bail in A.B.A. No.10843 of 2023.

Learned counsel for the State opposes the prayer for anticipatory bail on the ground that illegal spurious liquor was recovered.

Considering that the petitioner is neither the owner nor the tenant of the house in question where spurious liquor was recovered and the house in question was stated to be let out by one Kiran Dhara to Jitu @ Jitendra Gupta and the co-accused has been provided privilege of anticipatory bail in A.B.A. No.10843 of 2023, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of the learned Judicial Magistrate, East Singhbhum, Jamshedpur, in connection with Mango P.S. Case No. 298 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioner will not change his mobile number which is indicated in his Aadhar.
