06/09.05.2024 Heard learned counsel appearing for the petitioner and learned counsel for the State.

The petitioner is apprehending her arrest in connection with Telaiya P.S. Case No.214/2021, registered for the alleged offence under Sections 406, 420, 467, 468, 469, 471 and 120(B) of the Indian Penal Code, pending in the Court of the learned C.J.M., Koderma.

Learned counsel appearing for the petitioner submits that scholarship amount was credited in the account of the petitioner. He submits that when it transpired that it was wrongly credited, the said amount was returned by the petitioner. To buttress this argument, he refers Annexure-3. He submits that in identical situation, co-accused persons have been provided privilege of anticipatory bail in A.B.A. Nos.4178 of 2022, 3764 of 2023 and 7595 of 2023.

Learned counsel for the State opposed the prayer on the ground that the allegations are there of crediting the scholarship amount in the account of the petitioner.

Considering that co-accused persons have been provided privilege of anticipatory bail in the aforesaid A.B.As. and the petitioner has already

returned the amount and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, she will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Koderma in connection with Telaiya P.S. Case No.214/2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
