The petitioner is apprehending her arrest in connection with Barwadda P.S. Case No.165/2023, registered for the alleged offence under Section 467/468/471/420/34 of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate, 1^st Class, Dhanbad.

Learned counsel for the petitioner submits that the petitioner is the purchaser of the land in question and the said land was transferred to the petitioner by accused nos. 1 and 2. He submits that if any act is done by accused nos. 1 and 2, that can not be subject matter of criminal trial to the petitioner, who has purchased the land.

Learned counsel for the State opposed the prayer on the ground that illegally the land in question was transferred.

Considering that in paragraph 6 of the complaint, there is specific statement that the petitioner has purchased the land from accused nos. 1 and 2, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, she will be enlarged on bail on furnishing bail bond

of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Dhanbad in connection with Barwadda P.S. Case No. 165/2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
