the State.

This bail application has been filed on behalf of the applicant– Naveen Kumar with prayer to release on bail in connection with Sadar P.S. Case No.375 of 2023, corresponding to POCSO Case No.18 of 2024, registered under Section 366A of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-V, Special Judge (POCSO), Chatra.

The FIR of this case was lodged by the father of victim with these allegations that his 16 years old minor daughter was student of 9^th class. On 27.10.2023 at 9 O'clock in the morning she left the house for school but did not come back. Her mobile phone also came switched off. On 13.11.2023 during search he came to know that one Naveen Kumar bearing mobile no. 6287933887 had enticed her away with intent to have illicit relation with her.

During investigation victim was recovered from the house of petitioner on 21.11.2023 and statement of victim was recorded under section 164 of Cr.PC in which victim has stated that on 27.10.2023 she has left her house for school and she went to Hazaribag where Naveen Kumar had called her. From Hazaribag they went to Patna by the train from thereto Sitamarhi and then went to village Papdih where she had been residing with the petitioner for last 20 to 25 days and police apprehended them from there.

As per school certificate on the date of occurrence the victim

was 16 years and some months old. In her statement, victim has nowhere made any allegation against the present petitioner that he took her with intent to have any illicit relation with her.

In view of the above the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
