This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with S.T. Case No.44 of 2024 arising out of Khaga P.S. Case No.42 of 2023 registered under Sections 302/34 of the Indian Penal Code pending in the court of learned Additional Sessions Judge-I, Madhupur (Deoghar).

The F.I.R. of this case was lodged by the brother of the deceased— Balkishore Murmu with these allegations that his sister Dulari Murmu was married with Ugradeo Soren about one year ago. It is further alleged that on 6^th September, 2023 at 12 o’ clock her husband and mother-in-law both burnt his sister to death. It is also alleged that one hour before occurrence his sister had called him over the phone asking him to take her from the in-law’s house and when he reached there, he found that his sister was dead.

The place of occurrence is the house of Ugradeo Soren (the husband of the deceased) and the Investigating Officer after having received the information had recovered the dead body from his house and found the burn injury on the forehead, chest, hands and back of the deceased. These injuries are also mentioned in the inquest-report of the deceased. The informant in his re-statement has corroborated the prosecution story and also stated that on reaching there he found several burn injuries on the body parts of his sister. It is also alleged that her husband and motherin-law both used to torture her. The same kind of statement is given by Hiramati Murmu (the elder sister of the deceased), Upendra Murmu (the

uncle of the deceased) and Anita Murmu (the younger sister of the deceased). The independent witnesses, namely, Aloka Hembrom, Manik Chandra Hembrom and Rajkishore Murmu, who belong to the same locality where the accused reside have also stated that husband and mother-inlaw of the deceased used to torture her and they had also seen the deceased having burn injuries on different parts of the body. The postmortem report also corroborates the prosecution story.

In view of the submissions made and materials on record, the bail application of the petitioner is, hereby, rejected.
