Heard learned counsel for the parties.

The petitioner has been made accused in connection with Sadar P.S. Case No. 512 of 2023, registered under Sections 302 of the Indian Penal Code, pending in the Court of learned Judicial Magistrate, 1st Class, Ranchi.

As per F.I.R., on 30.11.2023 at about 09.00 P.M., the informant heard the sound of whining and she called her neighbour Shambhu Kumar Singh and told him to come. When her neighbour reached at her house, they found that the husband of the informant was lying in the drain facing downwards near her house and he has sustained head injuries and was bleeding. Thereafter, he was brought to the Hospital, where he was declared dead.

Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence at all rather he has been falsely implicated in this case only on the basis of confessional statement of co-accused. An F.I.R. was lodged by the petitioner Salo Devi @ Solo Devi for murder of her husband by some unknown miscreants, but later on, a false story was concocted by the police through confessional statement of Salo Devi @ Solo Devi. It is alleged that in connivance with her brother Kamru Nag and others, she has murdered her husband due to his illicit relationship with a lady Anjeeta Devi. The deceased was under influence of love with said Anjeeta Devi and was likely to transfer all his property in her name and was also addicted to liquor. confirming the involvement of the petitioner in the alleged offence. The petitioner is languishing in Judicial Custody since 17.12.2023 without any rhymes and reasons. After completion of investigation, chargesheet has been submitted. Petitioner has no criminal background and petitioner undertakes to cooperate in the trial of the case by remaining physically present as and when required and shall not indulge in any manner in tampering with the prosecution evidences or influencing the witnesses of prosecution. It is lastly submitted that co-accused persons namely Salo Devi @ Solo Devi and Kamru Nag with similar allegation have already been extended privilege of regular bail by this Court passed in B.A. No. 2763 of 2024 along with B.A. No.4618 of 2024 vide order dated 24.06.2024. Hence, the petitioner may be extended the privilege of bail.

On the other hand, learned A.P.P appearing for the State has vehemently opposed the prayer for bail of the petitioner but so far the matter of parity is concerned, it is admitted that the case of petitioner is on similar footing with the co-accused persons who has been granted regular bail by this Court.

Regard being had to the facts and circumstances of the case, nature of allegation coupled with the materials available against the petitioners and also in view of the fact that petitioner’s name has been transpired only on the confessional statement of co-accused and he is in judicial custody since 17.12.2023 having no criminal background, I am inclined to release the petitioner on regular bail. Accordingly, the petitioner named above is directed to be released on bail on furnishing of bail bond of Rs.25,000/- (Twenty Five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi in connection with Sadar P.S. Case No. 512 of 2023 subject to the conditions:-

(1) Petitioner shall remain physically present on each and every date till the conclusion of the trial of this case unless prevented from sufficient cause to the satisfaction of the learned Trial Court.

(2) Petitioner shall not indulge in any or other similar offence till the conclusion of the trial.

(3) Petitioner shall not indulge in tampering with the prosecution evidences or influencing the prosecution witnesses. In case of violation of the aforesaid conditions, the bail of the

petitioner shall be cancelled and shall be taken into custody by the learned Trial Court itself.
