The petitioner is apprehending his arrest in connection with Ranga P.S. Case No. 73 of 2022, registered under sections 175, 379, 414 of the I.P.C and sections 21(1), 21(6)/22 of the Mines and Minerals (Development and Regulation) Act, 1957, Rule 04/54 of J.M.M.C. Rule 2004 and Sections 07/09 of Jharkhand Minerals (Prevention of Illegal Mining) Transportation and Storage Rule, 2017, pending in the Court of learned Additional Chief Judicial Magistrate, Rajmahal.

Learned counsel for the petitioner submits that six tractors were apprehended and allegations are made that stone chips were being carried out. He submits that the petitioner is not name in F.I.R. and the name of the petitioner has come during investigation. He submits that allegations are made that stone chips were loaded from the crusher of this petitioner. He submits that driver and owner of the same F.I.R. have been provided anticipatory bail in A.B.A. No. 10909/2022 and A.B.A. No. 1635 of 2023. 4. Learned counsel for the State opposes the prayer for anticipatory bail on the ground that illegally the stone chips were being loaded from the crusher of this petitioner.

Considering that driver and owner of the same F.I.R. have been provided anticipatory bail in A.B.A. No. 10909/2022 and A.B.A. No. 1635 of 2023 and allegations are made that from the crusher of this petitioner stone chips were being loaded, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Rajmahal, in connection with Ranga P.S. Case No. 73 of 2022, subject to conditions as laid down under Section 438(2) of the Code of
