The petitioner is apprehending his arrest in connection with Dhanbad Mahila P.S. Case No. 35 of 2023, for the offences under Sections 498A/34 of the Indian Penal Code and Sections 3 / 4 of Dowry Prohibition Act, pending in the Court of Ms. Divya Raghav, learned Judicial Magistrate, 1^st class, Dhanbad.

Petitioner happens to be the husband of the prosecutrix. It is alleged that the prosecutrix was tortured by the petitioner and co-accused persons to enforce the demand of dowry.

Mrs. Jasvinder Mazumdar, learned counsel appearing on behalf of the petitioner has submitted that the prosecutrix has not sustained any injury at the hands of the petitioner.

Mr. Shailesh Kumar Singh, learned counsel appearing on behalf of the opposite party No.2 has vehemently opposed the prayer for anticipatory bail.

Considering the fact that no injury has caused to the prosecutrix, I am inclined to extend the privilege of anticipatory bail to the petitioner. He is directed to surrender before the court below within two weeks from the date of receipt of a copy of this order and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of Ms. Divya Raghav, learned Judicial Magistrate, 1^st class, Dhanbad, or her successor, in connection with Dhanbad Mahila P.S. Case No. 35 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
