The petitioners have been made accused in connection with Dhurki P.S. Case No. 39 of 2023, (S.T. No. 296 of 2023) registered under Sections 304 B, 34, of the I.P.C.

As per F.I.R., marriage of the informant’s sister, Majrun Bibi (Deceased) was solemnized with Mustakil Ansari with Muslims rites and rituals and just after one year of marriage her in-laws family members of his sister started torturing her and demanded additional dowry in the shape of Rs.1 lakh and a motorcycle. It is alleged that he was informed through mobile phone that her husband and other co-accused persons are planning to kill her.

Learned counsel for the petitioners has submitted that petitioners are mother-in-law and father-in-law of the deceased against whom there is general and omnibus allegations about demand of rupees one lakh and one motorcycle, after lapse of 6 years of marriage. Petitioners are old persons and have no concern with the relationship of the husband and wife and within the aforesaid period of six years not a single complaint or any other action was brought before any competent authority by the informant party. Petitioners are in judicial custody since 21. 07.2023.

Petitioners undertake to co-operate with the trial of the case and to remain physically present on each and every date till the conclusion of the trial and shall not indulge in tampering with the prosecution evidence or influence the witnesses or gain over them. Hence, the petitioners may be enlarged on bail.

On the other hand, learned Addl. P.P. has opposed the prayer for bail of the petitioners. Hence, petitioners do not deserve to be enlarged on bail.

Considering the facts and circumstances of this case materials available on record and also in view of the fact that nothing has been attributed against the petitioners, I am inclined to release the abovenamed petitioner, on bail. Accordingly, the petitioners named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/(Rupees twenty-Five thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge-V, Garhwa in connection with Dhurki in P.S. Case No. 39 of 2023 (S.T. Case No. 296 of 2023) subject to the conditions:

(1). Petitioners shall remain physically present on each and every date till the conclusion of the trial of this case unless prevented from sufficient cause to the satisfaction of the Learned Trial Court.

(2). Petitioners shall not indulge in any or other similar offence till the conclusion of the trial.

(3). Petitioners shall not indulge in tampering with the prosecution evidences or influencing the prosecution witnesses.

In case of violation of the aforesaid conditions, the bail of the petitioners shall be cancelled and shall be taken into custody by the Learned Trial Court.
