04/14.05.2024 Heard the learned senior counsel for the petitioner as well as the learned counsel for the respondent State.

The petitioner is apprehending his arrest in connection with Dumka (M) P.S. Case No. 119 of 2023, for the offence registered under sections 420 of the Indian Penal Code and under Section 7 of E.C. Act, pending in the court of learned Chief Judicial Magistrate, Dumka.

Learned counsel for the petitioner submits that the petitioner is a PDS dealer and the allegations are made that for the month of July, 2023 and August, 2023 the food grains were not distributed due to link failure. Now it is necessary to demonstrate the same on the website. However, the food grains for the month of July, 2023 and August, 2023 are distributed along with the month of September, 2023.

Learned State counsel opposed the prayer on the ground that allegations are there for non distribution of food grains for the months of July, 2023 and September, 2023. 5. Considering that the food grains for the month of July, 2023 and August, 2023 are distributed along with the month of September, 2023, I am inclined to provide privilege of anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Dumka, in connection with Dumka (M) P.S. Case No. 119 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
