06/ 13.05.2024 Heard learned counsel appearing for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Chandrapura Railway P.S. Case No. 15 of 2022, registered for the alleged offence under Section 379 of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate (Railway), Dhanbad.

Learned counsel appearing for the petitioner submits that the two mobile phones and certain cash were snatched from the running training of the informant by some miscreants. He submits that the petitioner is not named in the FIR and the name of the petitioner has come in the investigation and warrant has been received against the petitioner. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-10 of the petition. He also submits that the only allegation against the petitioner is that the petitioner was using the SIM of the stolen mobile.

Learned A.P.P. for the State has opposed the prayer on the ground that the SIM of the stolen mobile was used by the petitioner.

Considering that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-10 of the petition and the petitioner is not named in the FIR and in the investigation, it has come that the petitioner was using the SIM of the stolen mobile and in view of the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, he is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand), with two sureties of the

like amount each, to the satisfaction of learned Judicial Magistrate (Railway), Dhanbad, in connection with Chandrapura Railway P.S. Case No. 15 of 2022, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
