Both these bail applications arise out of the same police case and as such, both these bail applications are being heard together and disposed of by this common order.

Heard the parties.

The petitioners have been made accused in connection with Pathrol P.S. Case No.107 of 2023, for the offence registered under Section 364A of the Indian Penal Code, pending in the court of learned S.D.J.M., Madhupur.

During the intervening night of 27/28.11.2023, the informant alongwith others were on the way to Bherwa, Madhupur to attend Barat. When they reached near Kalhore More, they were overtaken by Maruti Ertiga Car and Swift Dzire car. The accused persons abducted Mithun Das and demanded ransom for his release.

It was submitted that petitioner Barjesh Thakur @ Barjesh Kumar Napit is neither named in the F.I.R nor he was identified in T.I. Parade. The only material against the petitioner is his confession regarding the involvement in the present case.

It was also submitted that the petitioner Vijay Kumar Yadav @ Chunchun @ Chunchun Yadav was put on T.I. Parade and he was identified by the victim.

Considering the aforesaid fact, I am not inclined to release the petitioner Vijay Kumar Yadav @ Chunchun @ Chunchun Yadav, on bail. Accordingly, his prayer for grant of bail is hereby rejected.

As far as petitioner Barjesh Thakur @ Barjesh Kumar Napit is concerned, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Madhupur, in connection with Pathrol P.S. Case No.107 of 2023.
