03/ 24.04.2024 : Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the complainant.

The petitioner is apprehending his arrest in connection with P.C.R. Case No. 230 of 2023, registered under sections 323, 354C, 498A and 504 of I.P.C, pending in the Court of learned Judicial Magistrate, Madhupur.

Learned counsel for the petitioner submits that petitioner is husband of the complainant and petitioner has gone to the house of the complainant and has taken her to his house. He submits that both the parties are residing together.

Learned counsel for the State submits that the case is arising out of matrimonial dispute.

Learned counsel for the complainant submits that both the parties are residing together. He submits that it is expected that the petitioner will keep the complainant with all dignity.

In reply, Mr. Choudhary, submits that the petitioner is keeping the complainant with all dignity.

Considering that the case is arising out of matrimonial dispute and both parties are residing together as submitted by the learned counsel for the petitioner and complainant, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of the learned Judicial Magistrate, Madhupur, in connection with P.C.R. Case No. 230 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioner will not change his mobile number which is indicated in his Aadhar.
