02 /18.04.2024 Heard the learned counsel for the petitioner as well as the learned counsel for the respondent State.

The petitioner is apprehending his arrest in connection with Jasidih P.S. Case No. 419 of 2023, for the offence registered under Sections 379, 414 and 34 of the Indian Penal Code, Section 21 of MMDR Act, Section 54 of JMMC Rules, 2004 and Section 15 of the Environment Act, pending in the court of learned Additional Chief Judicial Magistrate, Deoghar.

Learned counsel appearing for the petitioner submits that the petitioner is the owner of the tractor and he is not the owner of the trailer. He submits that allegations are made that on the trailer sand was loaded. He further submits that the petitioner has got no criminal antecedent that has been disclosed in paragraph No.9.

Learned counsel for the State opposed the prayer on the ground that illegally the sand was loaded on the trailer. 5. Considering that the petitioner is the owner of the tractor and he has got no criminal antecedent as disclosed in paragraph No.9, I am inclined to provide privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above

named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Deoghar, in connection with Jasidih P.S. Case No. 419 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
