04 /18.04.2024 Heard the learned counsel for the petitioners as well as the learned counsel for the respondent State.

The petitioners are apprehending their arrest in connection with Madhuban P.S. Case No. 55 of 2023, for the offence registered under Sections 364, 120-B of the Indian Penal Code, pending in the court of learned J.M. 1^st Class, Dhanbad.

Learned counsel appearing for the petitioners submits that there are case and counter case between the parties and on 10.06.2023 at about 7:30 P.M. one Sandeep Yadav along with other anti-social elements entered into the residential area of Dalits and assaulted several persons and misbehaved with the women and destructed their properties and they have also assaulted the villagers for that Madhuban P.S. Case No.53 of 2023 was registered. He submits that on the same day the present case has been lodged by the mother of the Sandeep Yadav.

Learned counsel for the State opposed the prayer on the ground that there is allegation of assault.

Considering that there is case and counter case prior to present case and on the complaint of the villagers Madhubani P.S. Case No.53 of 2023 was registered against Sandeep Yadav and

others thereafter the present case has been lodged by the mother of Sandeep Yadav.

In the attending facts and circumstances, I am inclined to provide privilege of anticipatory bail to the petitioner. 7. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each, to the satisfaction of learned J.M. 1^st Class, Dhanbad, in connection with Madhuban P.S. Case No. 55 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
