accused Munna Singh) had taken Power of Attorney from Maheshwar Prasad Singh for selling the said land vide Aam Mokhtar No. (iv) 462 dated 02.07.2014. The accused persons had induced the informant that the said land was free from dispute and was in their peaceful possession. Moreover, the petitioner of A.B.A. No. 1356 of 2024 entered into an agreement dated 16.08.2018 with wife of the Informant for selling the land @ Rs.2,90,000/- per kattha and on the same date, the informant paid Rs.2,00,000/- to the said petitioner vide Cheque No.312488. Thereafter, on 18.08.2018, the informant paid Rs.1,70,000/- in cash to Bharat Mahato and Munna Singh. Subsequently, the informant paid the rest amount of Rs.5,00,000/- through cheque issued in the name of the petitioner of A.B.A. No. 1356 of 2024 and handed it over to his son Sunil Kumar (the petitioner no. 1 of A.B.A. No. 1289 of 2024) on the date of registration of the land. Ashok Kumar (son of petitioner of A.B.A. No. 1356 of 2024) also took Rs. 1,00,000/- in cash from the informant against the registration charges. After registration of the land, when the informant went to the land for constructing boundary wall, he came to know that the land did not belong to the accused persons and they did not have possession over the said land. When the informant asked to refund the entire amount from the accused persons, the petitioner of A.B.A. No. 1356 of 2024 gave in writing on stamp papers that he would either give possession of the land within 03 months, or alternatively, he would provide another land, or would refund the entire amount. However, the said petitioner did not keep his promise. When the informant
