The petitioner is apprehending his arrest for the offences punishable under Section 414 of the Indian Penal Code, Section 4/21 of Mines and Minerals (Development & Regulation) Act, 1957, rule 4/54 of Jharkhand Minor Mineral Concession Rules, 2004 and rule 7/11 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017.

2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The petitioner is the owner of the seized vehicle bearing registration no. JH-01DF-3593. Except the fact that petitioner is the owner of the said vehicle, no incriminating evidence has been collected against him during the investigation. The petitioner is not at all involved in any sale, purchase and transportation of stone chips as has been alleged in the F.I.R. The petitioner has no criminal antecedent as has been stated in paragraph-17 of the present anticipatory bail application. Under the said circumstance, he may be given the privilege of anticipatory bail.

Having heard learned counsel for the parties, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Ranchi in connection with Dhurwa (T) P.S. Case No. 280 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
