Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner failed to make payment of due amount of his restaurant to the complainant- grocery shop owner and agreed to lease out his restaurant in favour of the complainant and consequent upon the agreement, the complainant paid Rs.10,00,000/- over and above the amount of Rs.7,45,000/- payable to the complainant by the petitioner but the petitioner is neither showing the title deed of the restaurant nor transferring the property as promised with intention to cheat the complainant. It is submitted that the allegation against the petitioner is false. It is further submitted that the dispute between the parties is basically a civil dispute. It is also submitted that the complainant is earning profit from the restaurant of the petitioner but he is not paying the outstanding amount to the creditors of the said restaurant and the petitioner has sent a legal notice and subsequently filed C.P. Case No.1753 of 2020 against the complainant. It is lastly submitted that the petitioner undertakes to cooperate with the trial of the case. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.
