Heard learned counsel for the parties.

2. Petitioner is apprehending his arrest in connection with Complaint Case No. C-11532 of 2023, for the offence registered under Sections 47 (a) and 55 of the Excise Act.

3. Learned counsel for the petitioner submits that he has falsely been implicated in this case. It has been alleged that 5 liters of illegal Mahuwa Chulai Liquor has been seized from his house and 10 liters of illegal foreign liquor has been seized from the coaccused. He further submits that the petitioner is not at all involved in any such type of crime and there is no criminal antecedent against this petitioner. He lastly submits that nothing has been recovered from the conscious possession of the petitioner, as such he may be enlarged on anticipatory bail.

4. Learned A.P.P. opposed the prayer for anticipatory bail.

Having regard to the facts of the case and the nature of allegation made against this petitioner coupled with fact that there is no criminal antecedent against the petitioner, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is directed to surrender before the court below within a period of four weeks from today and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Ranchi, in connection with Complaint Case No. C- 11532 of 2023, subject to the conditions as laid down under section 438(2) Cr.P.C.
