Heard the parties.
The petitioners have filed this application for quashing of the notice dated 25.02.2023 (Annexure-1) passed by the respondent No.2, the Circle Officer, Govindpur, Dhanbad, whereby, the respondent No.2 has directed the petitioners to hand over the vacant possession of land, morefully described in Annexure-1 to this writ application.
Counter affidavit has been filed on behalf of respondents-State, stating that the aforesaid notice has been withdrawn and proper legal action will be taken against encroachers after initiating appropriate proceeding in accordance with law.
Considering the aforesaid fact, no cause of action survives in this application. Accordingly, this writ application is dismissed as having become infructuous.
