07/15.03.2023 The present writ petition has been filed for issuance of direction upon the concerned respondent to enter the petitioner’s name in Register-II in terms with the order dated 09.01.2014 passed by the respondent No.5 in Misc. Case No. 15/2011-12.
Mr. Pankaj Kr. Choudhary, learned A.C to S.C (L&C)-II appearing on behalf of the State-respondents, refers to the supplementary counter affidavit filed on behalf of the respondent Nos. 1 to 6 and submits that in pursuance of the order dated 09.01.2014 passed by the respondent No.5 in Misc. Case No. 15/2011-12, the respondent No.6 initiated Misc. Case No. 05/2019-20 and after hearing the petitioner as well as the respondent No.7, disposed of the same vide order dated 10.02.2021 observing that the dispute between the parties can only be decided in title suit.
Since the respondent No.6 has already passed an order with respect to the petitioner’s claim to enter his name in Register-II with respect to the land in question, there is no need to further proceed with the present matter.
The present with petition is accordingly disposed of.
