This Criminal Appeal has been filed on behalf of the appellant challenging the judgment of conviction and order of sentence dated 24.05.2008 passed by Shri Amitabh Kumar, learned Sessions Judge, West Singhbhum, Chaibasa by which the appellant has been convicted for the offences under sections 341 and 324 of the I.P.C and sentenced to undergo S.I for One month under section 341 IPC and RI for three (03) years and a fine of Rs.5,000/- under section 324 of the IPC.
- It transpires that the Co-ordinate Bench of this Court vide order dated 23.11.2022 had issued notice upon the appellant Khirod Gope for his appearance. Pursuant to the said order the notice was issued by the office and the service report of the notice has been received which has been kept at Flag-X.
- From perusal of the Flag-X, it would appear that the Officer-in-Charge, Jagannathpur P.S., West Singhbhum, Chaibasa has sent a report to the learned Sessions Judge, West Singhbhum, Chaibasa that the appellant Khirod Gope has died 13-14 years ago and has also enclosed the certificate submitted by Mukhia Jolen Saban Bhuinya, Gram Panchayat Jagannathpur, West Singhbhum vide letter dated 11.05.2023.
