07/22.03.2023 This Criminal Appeal has been filed on behalf of the appellant challenging the judgment of conviction dated 07.09.2007 and order of sentence dated 11.09.2007 passed by learned Sessions Judge, Godda in Sessions Case No. 205 of 2006 whereby the appellant- Pandra Yadav has been convicted for the offence under Section 376 of the Indian Penal and has been sentenced to undergo R. I. for a period of seven (7) years and to pay fine of Rs. 5,000/- for the offence under Section 376 of the Indian Penal Code and in default of fine, further sentenced to undergo R. I. for a period of Six (6) months.
2. Learned counsel for the appellant has submitted that he does not want to press Cr. Appeal (S. J.) No. 1267 of 2007 as he has received instruction from the appellant- Pandra Yadav that the appellant- Pandra Yadav has been released from jail after serving the sentence imposed by the learned Court below and the learned counsel for the appellant does not press this Cr. Appeal (S. J.) No. 1267 of 2007.
3. Learned counsel for the State raised no objection.
