08/22.03.2023 The present Criminal Revision No. 1053 of 2017 has been filed on behalf of the petitioner challenging the judgment dated 29.04.2017 passed by Smt. Seema Sinha, learned Sessions Judge, Ramgarh in Criminal Appeal No. 16 of 2016 and Criminal Appeal No. 18 of 2016 whereby Smt. Seema Sinha, learned Sessions Judge, Ramgarh has dismissed the Criminal Appeal No. 16 of 2016 and Criminal Appeal No. 18 of 2016 by affirming the judgment of conviction and order of sentence dated 07.09.2016 passed by Sri. Dharmendra Kumar Singh, learned Chief Judicial Magistrate, Ramgarh in Connection with Ramgarh P. S. Case No. 319 of 2012 corresponding to G. R. No. 4644 of 2012 [ T. R. No. 1323 of 2016] whereby the learned Chief Judicial Magistrate, Ramgarh has found guilty the petitioners for committing the offence under Sections 352/504/506/34 of the Indian Penal Code and the petitioners have been released on probation of good conduct under Section 4 of the Probation of Offenders Act for a period of one year.

2. Learned counsel for the petitioners has submitted that bonds have already been furnished by the petitioners in light of the

judgment of conviction and order of sentence dated 07.09.2016 passed by Sri. Dharmendra Kumar Singh, learned Chief Judicial Magistrate, Ramgarh. It is submitted that one year has already been passed and as such, this Criminal Revision Application has become infructuous.

Learned counsel for the State raised no objection.

It transpires that the learned CJM has convicted the petitioners for the offence under Sections 352/504/506/34 of the Indian Penal Code vide judgment of conviction and order of sentence dated 07.09.2016, however, the learned Court below directed them to be released on their entering into bonds to keep peace and be of good behaviour and to prevent repetition of offence and they were further directed to remain under the supervision of Probation Officer for the period of one year.

It transpires that the learned Appellate Court has confirmed the judgment and sentence passed by the learned Court below.

It transpires that in light of the judgment of conviction and order of sentence dated 07.09.2016 passed by Sri. Dharmendra Kumar Singh, learned Chief Judicial Magistrate, Ramgarh, the petitioners have already furnished the bail bond for a period of one year, on 07.09.2016.

Under the circumstances, this Criminal Revision Application has become infructuous and is hereby dismissed as having become infructuous and stands disposed of.
