The instant appeal preferred under Section 21(4) of the National Investigation Agency Act, 2008 is directed against the order dated 24.02.2023 passed by the learned Addl. Sessions Judge-III, Dhanbad in Misc. Criminal Application 832 of 2023 in connection with S.T. No. 100 of 2023, arising out of Bankmore (Bhuli) P.S. Case No. 118 of 2022 by which the prayer for release of the appellant from judicial custody has been rejected.

It has been contended on behalf of the appellant that there is completely false allegation and merely on the ground that one pistol has been recovered from the house of the appellant, his complicity has been shown in the instant case.

It has been submitted that the other co-accused namely Godwin Khan has been granted bail in Cr. Appeal (D.B.) No.140 of 2023 vide order dated 13.02.2023 and Banti Khan @ Bunty Khan has been granted bail in Cr.Appeal (D.B.) No.113 of 2023 vide order dated 21.02.2023 by the Co-ordinate Bench of this Court. Even by the learned Trial Court accused Altaj Raja and Shamim Raja Ansari @ Chhotu have been granted bail in vide order dated 22.10.2022 B.P.No.1342 of 2022; Sajid Ansari @ Md. Sajid Ansari @ Bablu has been granted bail vide order dated 13.12.2022 in B.P.No.1637 of 2022 and Ayan Khan has

been granted bail vide order dated 22.10.2022 in B.P.No.1387 of 2022.

In view of the aforesaid background, submission has been made that the instant Cr. Appeal may also be allowed.

Mr. Abhay Kumar Tiwari, learned Addl. Public Prosecutor appearing for the State of Jharkhand has submitted that the case of the appellant is on different footing, since, the pistol has been recovered from the house of the appellant.

Considering the aforesaid, the order dated 24.02.2023 passed by the learned Addl. Sessions Judge-III, Dhanbad in M.C.A. No. 832 of 2023 in connection with S.T. No. 100 of 2023 is hereby quashed and set aside.

In view thereof, the instant appeal stands allowed.

In consequence thereof, the appellant, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees Ten thousand only ) with two sureties of like amount each to the satisfaction of the Additional Sessions Judge-III, Dhanbad in M.C.A. No.832 of 2023 in connection with S.T.No.100 of 2023, arising out of Bankmore (Bhuli) P.S. Case No. 118 of 2022.

Accordingly, the instant appeal stands disposed of.
