Mr. Vijay Kumar Sharma, learned counsel for the appellant has submitted that the instant appeal has been filed under Section 21(4) of the National Investigation Agency Act, 2008 on wrong presumption since the case has been instituted under Section 385, 387, 120(B) of IPC and under section 17 (i) (ii) of the C.L.A. Act, while the regular bail application under the provision of section 439 of the Cr. P. C has been filed.
Learned counsel appearing for the appellant, therefore, seeks leave of this Court to withdraw this appeal with liberty to file appropriate application. No objection to such prayer has been made on behalf of the learned A.P.P appearing on behalf of the State.
Considering the submission made on behalf of the learned counsel for
the appellant the instant appeal is dismissed as withdrawn, however, with liberty to the appellant to file appropriate application.
