This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 6466 of 2020 to its original file.
Learned counsel for the petitioner submits that the A.B.A. No. 6466 of 2020 was rejected as not pressed vide order dated 30.11.2021. Learned counsel for the petitioner submits that as the case could not be marked, hence, the conducting counsel could not appear, when the case was called out, which resulted in dismissal of ABA No. 6466 of 2020. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that A.B.A. No. 6466 of 2020 be restored to its original file.
Learned Addl. P.P. has no serious objection for the prayer of restoration.
Considering the aforesaid submission of the learned counsel for the petitioner, A.B.A. No. 6466 of 2020 is restored to its original file to the stage, it was before its dismissal.
List A.B.A. No. 6466 of 2020 after a week.
