Learned counsel for the petitioner submits that this criminal miscellaneous petition has been filed with prayer to modify the order dated 13.04.2022 passed in ABA no. 2524 of 2022. Learned counsel for the petitioner submits that vide order dated 13.04.2022 passed in ABA no. 2524 of 2022, the opp. party no. 2, herein, was given the privilege of anticipatory bail subject to payment of Rs. 1,00,000/- by way of demand draft drawn in favour of petitioner, herein, and in obedience to the said order, the opp. party no. 2, herein, prepared the said demand draft in the name of the “Dharmendra Keshri” being the petitioner, herein but the bank refused to accept the said demand draft on the ground of mismatch of the name as the banking name of the petitioner herein is “Dharmendra Kumar Keshri” , hence, it is submitted by learned counsel for the petitioner that the opp. party no. 2, herein, be directed to deposit a fresh demand draft of Rs. 1,00,000/- drawn in favour of “Dharmendra Kumar Keshri” in terms of the order dated 13.04.2022 passed in ABA no. 2524 of 2022, by way of modification.

Learned Addl.PP has no objection to the prayer of modification.

Considering the facts of the case, the petitioner is that 2 deposit the demand draft if already not deposited with the trial court and the trial court is directed to return

the demand draft deposited by the opposite party no. 2 herein in connection with Giridih (M) P.S. case no. 237 of 2021 with a direction to resubmit a fresh demand draft drawn in favour of “Dharmendra Kumar Keshri” within the time to be stipulated by the trial court.

In case, the opposite party no. 2 herein deposits the same, the trial court is directed to release the corrected demand draft in favour of the petitioner, herein.

In case, the opposite party no. 2 herein fails to furnish the demand draft within the time to be stipulated by the trial court, the trial court is directed to cancel the bail granted to the opposite party no. 2 herein- Suraj Yadav in connection with Giridih (M) P.S. case no. 237 of 2021.

The order dated 13.04.2022 passed in ABA no. 2524 of 2022 is modified to the aforesaid extent only.

This criminal miscellaneous petition is disposed of accordingly.
