aforesaid cartoon to be transported from Balli Singh's Beer Bar, Bistupur to Trax Beer Bar, Sakchi for which freight was fixed Rs. 150/-, After loading the cartoon the driver of the tempo had demanded the papers of the cartoon on which Yogender Singh disclosed that he is having the papers of the cartoon and asked the tempo to proceed for Sakchi and he is proceeding behind tempo on the said assurance the tempo driver proceeded towards Sakchi with the loaded cartoons, but the said Yogender Singh, on seeing the police party fled away for which the tempo driver convinced that the cartoon loaded in the tempo are illegal. In the mean time so many people assembled there and on the cooperation and help of Umesh Singh and Radha Krishna the informant inspected the cartoons loaded in the tempo and found 91 cartoons beer total 1092 bottles and 4 cartoon total 96 can beer. Thereafter seizure list was prepared in presence of witnesses, copy of which was given to the tempo driver. The informant claimed that without any document, transportation of beer for business from one place to another place by Yogender Singh, owner of Trax Beer Bar and Balli Singh liquor trader is punishable under Section 47(a) of the Excise Act and Section 420 of the Indian Penal Code. On the aforesaid allegations, the present case has been registered.
