This writ application has been preferred by the petitioner for a direction upon the concerned respondents to investigate into Kunda P. S. Case No. 145 of 2020 in the light of the directions given by the respondent no. 2 on the basis of the representation preferred by the father of the petitioner primarily on the ground of alibi based on various documents as well as CCTV footage.
Mr. Gautam Rakesh, learned A.P.P. for the State vide order dated 23.01.2023 was directed to take instruction as to whether any further investigation has been carried out with respect to the letter dated 28.03.2022. Today, on instruction he submits that the investigation is still going on and is likely to be completed shortly.
In view of the limited prayer made by the petitioner in this writ application and the fact that further investigation is already in progress in view of what has been stated by the learned A.P.P., this writ application stands disposed of with a direction to the respondent no. 3 to ensure that a fair and impartial investigation is carried out in Kunda P. S. Case No. 145 of 2020 and also to take into consideration the

representations along with the materials which have been submitted by the father as well as the wife of the petitioner as also the documents and other materials, if any submitted by them.
This writ application stands disposed of.
