3 /13.12.2023 This petition has been filed for quashing of the order dated 15.09.2015 passed by learned Additional Sessions Judge-IV, Dhanbad in connection with S.T. No.479 of 2012, G.R. No.1234 of 2010, pending in the court of learned Additional Sessons Judge -IV, Dhanbad.

The learned counsel for the petitioner submits that the learned court has cancelled the bail bond of the petitioner. She submits that the petitioner is ready to appear before the learned court on any date fixed by this Court and will cooperate in the investigation.

The leaned counsel for the respondent State has opposed the prayer on the ground that the petitioner has not appeared and in view of that, the trial has been split up and the accused persons who have faced the trial have been acquitted.

It appears that the learned court was left with no option as the petitioner was not appearing before the leraned court and in view of that the said order is passed, however, considering the submission of the learned counsel for the petitioner that the petitioner will cooperate and will appear before the learned court.

This petition is being disposed of directing the petitioner to appear before the learned court on or before 09.01.2024.

In the event of appearance of the petitioner on the said date and if any petition is filed by the petitioner, the learned court shall take a call on that petition in accordance with law.

It is made clear that if the petitioner will not appear before the learned court, the learned court will take all coercive steps against the petitioner.

This petition is disposed of accordingly.
