It is submitted by the learned counsel for the petitioner that vide order dated 29.08.2016, passed in A.B.A. No. 2136 of 2016, the petitioner was given the privilege of anticipatory bail with the condition that the petitioner will deposit his passport before the learned trial court and in compliance of the said order the petitioner has already deposited his passport in the learned trial court. It is next submitted that the younger son of the petitioner namely Saurabh Sinha and his wife are working in Phoenix, USA and his son is having serious backache and as both are very busy and in USA getting persons to work in house is too costly. The petitioner annexed two medical reports of his son and it is submitted by the learned for the petitioner that, it is necessary for the petitioner to visit his son. It is further submitted that the grandson of the petitioner is born in USA on 17th September, 2022 and the petitioner filed an application before the learned Special Judge, C.B.I., Dhanbad for granting permission to go abroad for one month but the said application has been rejected. It is next submitted that the petitioner filed a Criminal Miscellaneous Petition challenging the said order passed by the Special Judge CBI, Dhanbad the same has been dismissed as withdrawn. Hence, it is submitted that the order dated 29.08.2016, passed in A.B.A. No. 2136 of 2016 be suitably modified.
