Heard the parties.
Petitioner has been made an accused in connection with Haidarnagar P.S. Case No.46 of 2023, for the offences under Sections 376/506 of the Indian Penal Code and Sections 4/8 of the POCSO Act, pending in the court of learned Exclusive Special Judge, POCSO Act, Palamau.
Petitioner is said to have established consensual physical relationship with the proticutrix on the pretext of marriage. Subsequently, he refused to marry her.
Case diary earlier called for, has been received. Perused the same.
From paragraph-52 of the case diary, it appears that the victim is a major lady. It further appears that urine test for pregnancy was found to be negative.
Learned A.P.P. has opposed the prayer for bail.
Considering the aforesaid facts, the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/(Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Exclusive Special Judge, POCSO Act, Palamau in connection with Haidarnagar P.S. Case No.46 of 2023.
