Petitioner is apprehending her arrest in connection with Lohardaga Mahila P.S. Case No. 06/2022, for the offences registered under sections 498A, 494, 506 and 34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Lohardaga.

Petitioner happens to be the second wife of Kaish Alam. The Informant namely, Gulnaz Bano has instituted this case against her husband and this petitioner that without her consent, Kaish Alam had entered into second marriage. It is further alleged that when the Informant confronted this petitioner, she was abused and assaulted by her.

Mr. Altamash Khan, learned counsel for the petitioner, submitted that the petitioner is the victim of circumstance because Kaish Alam without taking her into confidence that he was married from before, has married her and committed fraud.

Considering the aforesaid facts, petitioner, above named, is directed to surrender before the learned court below within two weeks from the date of receipt of a copy of this order and the learned court below on her surrender, shall release her on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Lohardaga in connection with Lohardaga Mahila P.S. Case No. 06/2022, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
