This is an application for grant of anticipatory bail in a case registered under Sections 379/411 of the Indian Penal Code, Rules 4/22/54 of the Jharkhand minor Mineral Concession Rules, 2004, Section 21(i) of the Mines and Minerals (Development and Regulation) Act, 1957 and Section 9(B) of the Explosive Substance Act, 1884.

Learned counsel for the petitioner has submitted that petitioner is not indulged in business of the stone chips, rather he is the owner of Petrol Pump; petitioner has no criminal antecedent of such type of offence; other co-accused Miraj @ Mirajul Islam has been granted anticipatory bail by this Court in A.B.A. No. 9813 of 2022 by an order dated 05.01.2023 and the case of the petitioner stands on similar footing.

Learned A.P.P. appearing for the State opposes the prayer for bail.

Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail in the event of his surrender/arrest within four weeks from today in connection with Shikaripara P.S. Case No. 73 of 2022 on his furnishing bail bond of Rs.20000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Dumka, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also with the condition that he will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the pendency of the case.
