This is an application for grant of anticipatory bail in a case registered under Sections 341, 323, 420, 406, 120-B, 504, 506 of the IPC.

Allegation against the petitioners is that the informant’s husband during his lifetime entered into agreement for sale in the year 2008 for some land with the father of the petitioners and out of Rs.28.00 Lakh consideration amount, Rs.20.00 Lakh was paid to the petitioners’ father, but no sale-deed has been executed till date.

Learned counsel for the petitioners has submitted that the informant is in possession of the land in question on the strength of an agreement for sale of the year 2008 executed by her husband who died in 2015 and the alleged vendor of the land also died in 2012 itself. The informant has not taken any step for getting the sale deed registered either from the father of the petitioners or from the petitioners.

Learned A.P.P. appearing for the State opposes the prayer for bail.

Considering the fact there appears to be a land dispute between the parties, both the petitioners, named above, are directed to be released on bail in the event of their surrender/arrest within four weeks from today in connection with Parsudih P.S. Case No. 11 of 2022 on his furnishing bail bond of Rs.20000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Jamshedpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
