02/ 14.02.2023 . Petitioner above-named who is in custody since 13.11.2022 has moved this Court for grant of regular bail in connection with Mango P.S. Case No.148 of 2017 corresponding to G.R. No.1404 of 2017 registered under Sections 147/ 148/ 149/ 341/ 323/ 307/ 427/ 295(A)/ 353/ 332/ 120(B) of the Indian Penal Code. Heard the parties.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence.
It is further submitted that the incidence took place when the mob was protesting against the murder of four persons. When the Police came to disburse the mob, it was attacked. The case was registered against altogether 78 named accused persons and the name of the petitioner does not figure in the same.
Learned APP for the State has vehemently opposed the prayer.
Considering the submissions of learned counsel and the fact as discussed above, the bail application is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below.
