Petitioner is apprehending his arrest in connection with Kandra P. S. Case No. 77/2022, corresponding to G.R. No. 677/2022, registered under Section 379 of the Indian Penal Code, pending in the Court of learned C.J.M.,Seraikella.
It appears that on 22.09.2022, at about 11:35 A.M., unknown persons committed theft of a gold locket from the shop of the informant. During the course of investigation, one Md. Fardeen was apprehended and his confession led to arrest of coaccused Sahil Hussain and Amir Ali. It further appears that the gold locket was also recovered on the basis of his confession.
Certified copy of the charge-sheet has been filed, from the perusal of which it appears that after the occurrence co-accused had talked to this petitioner on his mobile phone.
It was submitted that apart from the fact that the petitioner had talked to co-accused Md. Fardeen on his mobile phone, there is no other material against the petitioner on the record.
Learned Spl.P.P. has opposed the prayer for bail of the petitioner but does not dispute the aforesaid fact.
Regard being had to the facts and circumstance of the case; I am inclined to extend the privilege of Anticipatory Bail to the petitioner. He is directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on his surrender shall release him on bail on
furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Seraikella in connection with Kandra P. S. Case No. 77/2022, corresponding to G.R. No. 677/2022, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
