Heard both the counsels.

Learned counsel for petitioner has submitted that the petitioner is innocent and he is not concerned with the alleged place of occurrence nor he is the owner of the seized sand nor he claims the same. It is further submitted that the petitioner has been implicated in the present case on the basis of the alleged information collected from the nearby people without giving their name. It is further submitted that petitioner is neither the owner of the land nor the owner of the seized sand. It is further submitted that petitioner is not involved in any other case. Moreover, counsel says that another co-accused, namely, Vidya Bhushan Sahu has been granted anticipatory bail by this Court in ABA No. 6569 of 2023 vide order dated 1^st December, 2023 and his case stands on similar footing, therefore, the petitioner may also be granted the privilege of anticipatory bail.

The learned counsel for the State, learned APP has opposed the anticipatory bail application but not denied the cited anticipatory bail order.

Having heard counsels for both the side; having gone through the records of the case and in the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner and accordingly, the petitioner, above named, is directed to surrender in the court below within three weeks from today and in the event of his arrest or surrender the court below shall enlarge the, above named petitioner, on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty Five Thousand only), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gumla in connection with Gumla P.S. Case No. 120 of 2023 , subject to the condition as laid down under section 438(2) of the Cr.P.C., with further condition that the the petitioner shall attend the trial regularly and he will submit self-attested photocopy of his Aadhaar Card and also submit his

mobile number before the learned Court below which he will always keep active and will not change it during pendency of this case without prior permission of the Court.
