Heard the learned counsels for the parties.

The petitioner is an accused in a case registered under sections 363 and 364 A of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is not named in the FIR and his name has been transpired only on the basis of confessional statement of co-accused Brajesh Mandal. It is further submitted that amongst the other co-accused one is Ritu Raj Yadav @ Ritik Raj @ Rituraj Yadav who happens to be the cousin of the person who has been kidnapped and it was through him the plan for kidnapping was evolved. It is further submitted that in the entire case record it is not revealed that the petitioner has demanded the ransom money or received the same from any person. It is further submitted that the boy was returned very next date and left near the police station near the boys house. It is further submitted that petitioner is a young boy of 20 years and still a student and further he has no other criminal antecedent as per para 17 of the petition. It is further submitted that petitioner is not a hardened criminal and moreover he is in custody from 14.8.2023, therefore based on these circumstances, the petitioner may be granted the privilege of bail.

Learned counsel for the State, on the other hand, has opposed the bail petition and submitted that serious offence of kidnapping of a very young boy was committed and his name come on the basis of confession of another co-accused, therefore, the petitioner does not deserve bail.

Having heard both counsels, gone through the records of the case and in the facts and circumstances of the case, I am inclined to release the petitioner, named above, on bail, on furnishing bail bond of Rs. 25,000/(rupees twenty five thousand only) with two sureties of the like amount

each to the satisfaction of learned Chief Judicial Magistrate, Sahibganj in connection with Borio (J) P.S. Case No. 100 of 2023, subject to the condition that the petitioner shall remain present on each and every date of trial before the Court below unless dispensed with by the learned Court below with further condition that the petitioner will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
