05/19.04.2023 The applicant who is in custody since 01.12.2022 has approached this Court for grant of regular bail in connection with Tamar P.S. Case No.95/2021.

The applicant has been made accused for the offence under Sections 17(C)/ 18(b) of N.D.P.S. Act.

It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part .

Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. It has been submitted by learned counsel for the applicant that the applicant has been roped in on the basis of confession of the co-accused, namely, Janardan Seth @ Lokhai Seth who has already been enlarged on bail by this Court vide order dated 31.08.2022 passed in B.A. No.6076 of 2022. On above basis, prayer for bail has been made.

Learned A.P.P. has opposed the prayer for bail of the applicant and submitted that this applicant was evading the arrest and only after issuance of process he could be arrested.

It has been replied by the learned counsel for the applicant that he was pursuing his remedy and finally he has got liberty from the Hon’ble Apex Court to surrender in the court below within three weeks vide order dated 21.11.2022 passed in S.L.P. (Crl.) No.10910 of 2021 and thereafter he has surrendered.

Considering the fact that one of the apprehended co-accused has been enlarged on bail, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Commissioner, Ranchi in connection with Tamar P.S. Case No.95/2021, subject to the conditions that the applicant will submit self-attested copy of his/her/their Aadhaar Card and also give his/her/their mobile number before the learned court below which he/she/they will not change during pendency of this case without prior permission of the court.
