04/ 12.06.2023 . Petitioner above-named who is in custody since 16.11.2022 has moved this Court for grant of regular bail in connection with Ramgarh P.S. Case No.354 of 2009 (G.R. No.4714 of 2009) registered under Sections 406/ 420/ 34 of the Indian Penal Code.
Heard the parties.
As per the case of the prosecution, the petitioner/accused was serving as Junior Engineer in the Department of Rural Development Department, Hazaribagh since April, 2005 to 20th March, 2009. A complaint was received in the office of the Hon’ble Governor’s Secretariat on 13.02.2009 regarding irregularities committed in Rural Development Department, Hazaribagh cum Ramgarh in the cash register regarding different schemes. It is alleged that lump-sum amount was given to the Executive Engineer, this petitioner /accused as well as to the others of the Rural Development Department for execution of different schemes. An enquiry was conducted under the direction of the Deputy Commissioner and on irregularities being found, the case was registered.
It is submitted by learned Senior counsel for the petitioner that petitioner is a retired person aged about 67 years and no dues certificate was granted in favour of the petitioner which has been enclosed as Annexure-2 to the bail petition. There was no amount due with this petitioner and similarly situated co-accused persons have already been enlarged on bail by this Court. Learned SPP for the State has vehemently opposed the prayer. It is submitted that after investigation, charge-sheet has already been submitted. It is submitted that Rs.25 Lakhs were advanced for execution of 52 schemes, out of which only 17 schemes were initiated.
Considering the submissions of learned counsel and the fact as discussed above, the bail application is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand ) with two sureties of the like amount each
to the satisfaction of learned Court below subject to the condition that one of the bailor(s) must be close relatives of the petitioner .
