Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner along with coaccused has misappropriated MNREGA amount of Rs.12,50,000/without doing proper work with respect of Scheme No. 263/08-09 regarding the construction of a road from village Saranga Chamna Tola to Makodkocha Tin Siman. It is next submitted that the petitioner was Executive Engineer of Zila Praishad, Chaibasa at the time of occurrence and the construction made grading (the size) of the metal used in construction of the road) was not within the specified range and the required limit of Murom should be 20% maximum, but it was found to be 22% which is beyond the permissible limit and there was also irregularity in payment of wages. It is further submitted that the coaccused Manoj Kumar, who has already been granted privilege of anticipatory bail by this court vide order dated 28.02.2020 passed in ABA no. 709 of 2020 upon his voluntarily willing to co-operate with the investigation of the case and depositing Rs. 3,20,000/- with the Deputy Commissioner, West Singhbhum at Chaibasa, subject to final decision of the case without prejudice to his defence in this case and the case of the petitioner stands on better footing.
