Petitioner is apprehending his arrest in connection with Senha P.S. Case No. 91/2022, corresponding to G.R. Case No.25 of 2023, for the offences under Sections 379/411 of the Indian Penal Code, Rules 4 and 54 of the Jharkhand Minor Mineral Concession Rules, 2004, Rules 7 and 13 of the Jharkhand Mineral (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in the court of learned Sub-Divisional Judicial Magistrate, Lohardaga.

Petitioner is the owner of tractor, which was seized by the Circle Officer, Senha, Lohardaga loaded with 100 CFT. of sand.

It was submitted that the driver of the offending vehicle without consent and knowledge of the petitioner had loaded the seized sand. It was further submitted that petitioner has got no criminal antecedent and this fact has been mentioned at paragraph-19 of the Anticipatory Bail Application.

Learned A.P.P. has opposed the prayer for Anticipatory Bail.

Co-accused Manish Kumar Singh has been granted Anticipatory Bail by this Court vide A.B.A. No.1347 of 2023 and the case of this petitioner stands on similar footing.

Regard being had to the facts and circumstance of the case, I am inclined to enlarge the petitioner on anticipatory bail. He is directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on his surrender shall release him on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Lohardaga in connection with Senha P.S. Case No.91/2022, corresponding to G.R. Case No.25 of 2023. Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
