Heard learned counsel for the parties.

Apprehending his arrest in connection with Doranda P.S. Case No. 35/2022, registered for the offence under Sections 420, 406 and 34 of the Indian Penal Code, the petitioner has moved this Court for grant of privilege of anticipatory bail.

It is alleged that petitioner and Dinanath Prasad induced the informant to give admission in P.G. to his daughter Ruhi Kumari and took Rs. 51,41,750/-. As per allegation when informant asked for admission they pretend and did not return the amount.

Learned counsel for the petitioner has submitted that in terms of order dated 21.06.203, the matter has been referred before the JHALSA, Ranchi and the matter has been settled between the parties on certain terms and conditions. Hence, the petitioner may be extended the privilege of anticipatory bail.

Learned A.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.

Learned counsel for the informant has not denied the aforesaid

Considering the facts and circumstances of this case, the nature of allegation against petitioner coupled with materials available on record, I am inclined to extend privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court within four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on furnishing bail bond of

Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ranchi in connection with Doranda P.S. Case No. 35/2022 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

Petitioner is directed to file an undertaking at the time of furnishing bail bond about the compliance of terms and conditions entered between the parties at the mediation center at JHALSA, failing which, necessary recourse may be taken in the trial court itself.
