Petitioner is apprehending her arrest in connection with Domchanch P.S. Case No. 160 of 2022, for the offences under Sections 467, 468, 471, 420, 379, 411 of the Indian Penal Code, Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017 and Rule 54 of Jharkhand Mines and Minerals Concession Rules, 2004, pending in the Court of Sri Prashant Kumar Verma, learned Judicial Magistrate, 1st class, Koderma.

On 26.12.2022, the informant District Mining Officer, Koderma seized four trucks loaded with stone chips. Drivers of the seized trucks produced challan for transporting the stone chips, which was issued by the petitioner. Petitioner is the proprietor of M/s Ganpati Minerals.

Learned counsel for the petitioner has submitted that petitioner is the proprietor of M/s Ganpati Minerals and she has got the license to quarry stone chips and the seized stone chips were being transported on the basis of valid challan.

Criminal antecedent report of the petitioner earlier called for, has been received.

It appears that the petitioner has got no criminal antecedent.

Considering the aforesaid fact; I am inclined to extend the privilege of anticipatory bail to the petitioner. She is directed to surrender before the court below within two weeks from the date of receipt of a copy of this order and the learned court below on her surrender shall release her on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of Sri Prashant Kumar Verma, learned Judicial Magistrate, 1st class, Koderma, or his successor, in connection with Domchanch P.S. Case No. 160 of 2022, subject to the the conditions as laid down under Section 438 (2) Cr.P.C.
