Petitioner is apprehending his arrest in connection with Koderma P.S. Case No. 264/2022, registered under Sections 147/ 149/ 341/ 323/ 504/ 506/ 420/ 467/ 468/ 471 of the Indian Penal Code, pending in the Court of learned C.J.M., Koderma.

It is alleged that the petitioner was trying to disposes the informant from his land. When the mother and wife of informant opposed, they were assaulted due to which his mother sustained injury.

It was submitted that the petitioner was the owner of the land in question and he was also in possession of the same. The informant party were disturbing his possession due to which this occurrence has taken place. It was finally submitted that for the same occurrence, petitioner had also instituted a counter case, prior to the present case.

Learned lawyer for the informant has vehemently opposed the prayer for bail of the petitioner.

From the perusal of the case diary, it appears that the mother of the informant had sustained simple injuries. The genesis of the occurrence is land dispute between the parties, for which both, case and counter case was instituted.

Regard being had to the facts and circumstance of the case; I am inclined to extend the privilege of Anticipatory Bail to

petitioner. He is directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Koderma in connection with Koderma P.S. Case No. 264/2022, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
