03/ 15.06.2023 . Apprehending his arrest, petitioner above-named has moved this Court for grant of anticipatory bail in connection with Chakradharpur P.S. Case No.137 of 2022 registered under Sections 341, 323, 307/34 of the Indian Penal Code.

Heard the parties.

It is submitted by learned counsel for the petitioner that father of the petitioner is shop-owner and minor scuffle took place between the informant and his father when he approached him for purchase of glass and bottle of water. It is further submitted that the informant was under the influence of liquor at the relevant point of time and he had abused the father of the petitioner resulting in dispute. The matter has been amicably settled and compromise petition has also been filed before the learned court below. It is submitted that all the sections are compoundable except Section 307 IPC which will not be made out in the facts & circumstances of the present case.

Learned APP for the State has vehemently opposed the prayer.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under Section 438(2) Cr. P.C.

The petitioner will co-operate in the investigation and will appear on notice under Section 41 A of Cr.P.C. as and when his presence is required.
